Please read these Terms and Conditions ("Terms") carefully before using the VSKS application (the "App") or the vsks.lt website (the "Website"), operated by Quassum MB ("we", "us", or "our"), a company registered in Lithuania.

By downloading, installing, or using the App or accessing the Website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App or Website.

1. Description of Service

VSKS is a Lithuanian keyboard application for iOS that provides a custom keyboard experience, including but not limited to Lithuanian character input, grammar checking, and other keyboard-related features. The App may include both free and paid features.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. This license does not allow you to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Copy, distribute, or create derivative works based on the App
  • Rent, lease, lend, sell, or sublicense the App
  • Remove, alter, or obscure any proprietary notices in the App

3. User Accounts

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account.

4. Purchases and Subscriptions

The App may offer in-app purchases or subscriptions. All purchases are processed through Apple's App Store and are subject to Apple's terms and policies. Refund requests must be directed to Apple. Prices may change at any time without prior notice.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers connected to the App
  • Use the App to transmit any malware, spam, or harmful content
  • Use the App in any way that could damage, disable, or impair the service

6. Intellectual Property

The App, including its design, code, graphics, logos, and all related content, is the property of Quassum MB and is protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

8. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE APP'S CONTENT OR FEATURES, INCLUDING BUT NOT LIMITED TO GRAMMAR CHECKING, SPELL CHECKING, OR TEXT SUGGESTIONS.

YOUR USE OF THE APP IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUASSUM MB AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE APP EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Quassum MB and its directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
